TERMS & CONDITIONS
1. Introduction
Welcome to Pinoy Ride, a Filipino-made ride-hailing platform committed to providing safe, reliable, and culturally grounded transportation services within the Philippines. By downloading, accessing, or using the Pinoy Ride app (the “Platform”), both passengers and riders (drivers) agree to be bound by these Terms and Conditions.
2. Definitions
“Pinoy Ride” – The company operating the ride-hailing platform.
“Platform” – The Pinoy Ride mobile application and related systems.
“Passenger” – Any individual using the app to request transportation.
“Rider” or “Driver” – Any individual providing transportation services using the Pinoy Ride platform.
“Booking” – A confirmed ride request through the app.
“Fare” – The amount payable by the passenger for a completed trip.
3. Eligibility
3.1 Passengers
- Must be physically located within the Philippines at the time of booking or using the Service.
- Must provide accurate registration details.
- Must have a valid payment method (cash or in-app payment, depending on features available).
3.2 Riders
- Must meet all government requirements for transport service providers in the Philippines (e.g., LTO, LTFRB compliance).
- Must have a valid professional driver’s license.
- Must pass Pinoy Ride’s onboarding and verification.
4. Use of the Platform
4.1 Passenger Responsibilities
- Must be physically located within the Philippines at the time of booking or using the Service.
- Must provide accurate registration details.
- Must have a valid payment method (cash or in-app payment, depending on features available).
4.2 Rider Responsibilities
Riders agree to:
- Maintain a roadworthy, presentable, and clean vehicle.
- Drive safely and follow all traffic rules.
- Accept bookings responsibly and avoid unjust cancellations.
- Treat passengers with courtesy and respect.
- Follow Pinoy Ride’s community guidelines, policies, and requirements.
5. Booking and Cancellation Policies
5.1 Passenger Cancellations
- Passengers may cancel a ride before the Rider arrives with no cancellation fees.
- Excessive cancellations may result in account warnings or suspension.
5.2 Rider Cancellations
- Riders should only cancel for valid reasons (vehicle issues, emergencies, passenger safety concerns).
- Unjustified cancellations may affect rider ratings and incentives.
6. Fares and Payments
- Fares are calculated based on distance, time, traffic, and dynamic pricing (if applicable).
- Passengers must pay the full fare at the end of each trip. Additional fees (e.g., tolls, parking) must be shouldered by the passenger unless stated otherwise.
- Riders will receive earnings minus Pinoy Ride’s service commission/fees.
7. Ratings and Feedback
- Passengers may provide a rating or feedback for Riders/Drivers.
- Consistently low ratings may lead to temporary or permanent account suspension.
- False or abusive feedback is prohibited.
8. Safety and Conduct
8.1 Prohibited Behaviors
Passengers and riders must NOT:
- Engage in harassment, discrimination, or violence.
- Bring illegal substances or weapons.
- Use the Platform for unlawful activities. Damage vehicles or company property.
8.2 Safety Measures
- Pinoy Ride may implement emergency features, in-app safety tools, and monitoring systems.
- Both parties must cooperate with any safety investigations conducted by Pinoy Ride.
9. Vehicle & Rider Compliance (For Drivers)
Riders must ensure:
- Vehicle registration, insurance, and permits are valid. Compliance with LTFRB and LTO regulations.
- Regular vehicle maintenance and cleanliness.
- Professional and respectful conduct during all rides.
- Failure to comply may result in suspension or deactivation.
10. Personal Data & Privacy
- Pinoy Ride collects necessary personal information for service operation.
- All data is processed following the Data Privacy Act of 2012 (Philippines).
- Data will not be sold to third parties without user consent.
11. Liability and Limitations
- Pinoy Ride serves as a technology platform, not a transportation operator.
- Riders operate as independent service providers.
- Pinoy Ride is not liable for damages arising from accidents, misconduct, or disputes between passengers and riders, except as required by law.
- Passengers and riders must report incidents within 24 hours for proper resolution.
12. Account Suspension or Termination
Pinoy Ride may suspend or deactivate accounts for:
- Fraud or document tampering.
- Violations of safety policies.
- Repeated cancellations or misconduct.
- Harassment or abusive behavior.
- Illegal activity or breach of Terms.
13. Dispute Resolution
- Users may file complaints through the in-app help center or official customer support channels.
- Pinoy Ride will investigate disputes fairly and objectively.
- Legal disputes shall be governed by Philippine laws and settled within Philippine jurisdiction.
14. Amendments to Terms
Pinoy Ride reserves the right to update or modify these Terms at any time. Continued use of the Platform signifies acceptance of any changes.
